The 2nd U.S. Circuit Court of Appeals in New York upheld a lower court’s decision that the city did not discriminate against Robert Jordan because the same standards were applied to everyone who took the test.

So if I test everyone to see if they're black and then don't hire black people, does that make it not discrimination, since I tested *everyone* to see if they were black and held them all to that standard?
