It goes back, kind of. The Legislative branch votes to override the veto, but you need way more votes...

If two thirds of both the House of Representatives and the Senate vote to override the veto, the bill becomes law without presidential approval.

The only reason that Obama is going to veto the bill is because it doesn't grant him ENOUGH power to detain whoever the fuck he wants. He doesn't want there to be ANY rules or restraints on his power to do that whatsoever, and that is the reason for his promised veto. It certainly isn't for reasons that we would consider just and good.
