Not exactly. The Klon uses 4 op amp stages, though the first is a unity gain buffer.

Like those others, there is an op amp followed by clipping diodes, but there are differences in the make up gain and tone control sections following it.

It's really not so much about the circuit, anyway, as there is nothing anyone has ever done with a guitar pedal circuit using basic op amps and transistors that falls under any kind of trademark or IP protection, though one can copyright the PCB layout, but that isn't hard to get around by any manufacturer designing their own PCB from scratch.

Whatever one thinks of Behringer, they are really only crossing the line with trade dress and names.

i’m sure MusicTribe’s lawyers, who are no doubt expert and legion, have already been amassing examples of pedals that infringed on original packaging to show that this really isn’t that far beyond standard industry practice.

i’m not a fan of Behringer, but i have no compunction about using their products. yeah, some are awful, though if you buy stomp boxes in plastic enclosures the fault lies with you. but some of their synths are the only way i’ll
ever get to use a lot of classic sounds. so i’m not prepared to write them off.

i also am not impressed with Finnegan, who from what i’ve heard is not pleasant to deal with. if i was going to pick a complainant i’d prefer someone less full of themselves. and i find his “i only sell them on eBay to the highest bidder” schtick exploitative in the extreme. not a sympathetic client.

and i have to say that’s a really shitty brief. badly written as a hagiography of Finnegan, it barely does the job of asserting claims. not impressed by his lawyers.

One problem with that is that many of those examples would be their own products.

I don't see the outrage honestly. From the "Archer" to the Warm Audio Centavo, they all have various derivatives of the trade dress.

And for the record, my TC Zeus and the Centavo are interchangeable - one is just 5x the size.

But hey, I had the space..so...

My small fuckaround board if I don't feel like leaving the house to do proper studio stuff in the other building.

I personally don't like Behringer, too. Only had bad experiences with their products and their business practices are at least very questionable in my opinion but I, too, find it mildly interresting that Warm Audios clones are mostly accepted while Behringer often seems to really enrage people for doing the same.

WA didn’t steal the product name (theirs is Centavo) or logo. Ceriatone was closer on the Centaura trade name, but the logo, when used is quite distinct, with the flung guitar rather than a swung sword. The J Rockett Archer has distinctly different name, logo, and box appearance. If the Behringer logo isn’t a precise copy you’re really gonna need to look for the differences.

Behringer could have skirted this the same as anyone else with a different name and different art. But they’ve always been shameless about IP, down to using Aphex’s actually PCB art including Aphex’s name back in the 90s.
