OK, (1) why should anyone believe an anonymous report like this? (it's so Orwellian, I have a hard time giving it any credence)

Let's say there's 100,000 listings currently on Reverb. Thousands of items are sold everyday. Hundreds, if not thousands, of listings are ended everyday, because people change their minds, pay their bills, or sell elsewhere. Without having specific cause, I don't see a scenario where Reverb would be investigating such a matter. Reverb doesn't have the work force to sift through hundreds of thousands of listings and e-mails.

Reverb can barely keep the site running smoothly. I find glitches and broken links all the time. If they can't even make the site run better, how can they afford a shadow team of Gestapo agents to wrangle up these precious commissions?

(3) Even if Reverb read a user's private correspondence to verify site misuse (which they may be entitled to, depending on their terms of service), it would ultimately be up to the seller, if they wanted to pony up.

If Reverb told me I owed them 3.5% on a sale, I could hypothetically say the sale fell through. What are they going to do--subpoena my PayPal records? They have no legal standing to do that. If they wanted to charge my bank card without my authorization, I'd file a complaint with Visa and it'd be thrown out.

Reverb isn't going to hire a law firm to sue people for commissions. Even on a $200,000 sale, that'd only amount to $7,000 in payouts. That's not worth the trouble of hiring a powerful firm.

(4) The worst-case scenario I see for people who use Reverb to arrange private sales is a site suspension or termination. If Mr. Smith comes to me and says Reverb charged him for making a sale off the site, then it just raises too many ?s on the bullshit meter.

I'm not saying people should abuse Reverb's user terms. I just don't see Reverb having the legal means to actually enforce the honor code.

The result would be that Reverb would simply ban a user if they had evidence terms were violated. They wouldn't bring a lawsuit. You're jumping to extremes that were not implied. I walked past reverb's offices recently and its a pretty substantial operation based on the amount of property they are leasing. It would be very simple to filter their message system for phone numbers and email addresses and look at communications associated with recently ended listings. Regardless, the max fee on a Reverb sale is $350, not a blanket percentage up to any amount. No one would be demanding $7,000. You can choose to believe or not believe anything.

Looking over his comments and reviewing Reverb's position, I think this is about legal protection for Reverb, more than it is about general pettiness of trying to claim a 3.5% sales fee. (that is assuming his claim is legitimate, he doesn't offer a screen capture or billing records) If people use Reverb as a means to commit fraud or to engineer other crimes (robbery, assault), then Reverb is in a position where it is ideal to enforce their policies without deviation, in order to guard against legal responsibility in any criminal practice.

---I wouldn't pay it personally, I'd have it removed from my sales history, but I understand why it's important for them to enforce their terms consistently, in order to protect against lawsuits or legal accountability, in matters of misconduct.

I thought Visa offered two-way protection, so they just ate it on something like that. I'm not familiar with the details of this particular transaction or where it took place, so I can't speculate beyond that.

I've always been curious how Visa investigates potential fraud, if the buyer is in fact the cardholder (and just running a scam). ---If the seller has proof of shipment, will Visa contact the agency of the driver? If the local driver states that he delivered it to the buyer's address, and the cardholder lives there, it seems like the buyer/cardholder would be fucked.

When I got a busted-up drum machine through eBay, eBay fucking passed the buck, and PP was less than helpful. But I think Synchrony (my PP credit line issuer) ate the charges and refunded me, without forcing the seller to refund me himself. ---The machine was clean in photos, but non-working. I bought it, thinking it'd be a simple repair. Of course what I got was a busted to hell piece of shit that looked nothing like the auction photos. eBay said it was sold as a repair project, so tough luck. I told PP that the item was grossly misrepresented and they refunded me, after I got Synchrony involved.
